PreventifyThese Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Preventify LLC ("Preventify," "we," "us," or "our"), a Texas limited liability company. By downloading, installing, accessing, or using the Preventify mobile application ("App"), you agree to be bound by these Terms in their entirety. If you do not agree, you must immediately cease use of the App and delete it from your device.
1. PURPOSE AND SCOPE
Preventify is a sport-specific injury prevention application that provides general fitness guidance and exercise programming designed to help athletes reduce injury risk. Preventify is intended for use by athletes and fitness enthusiasts aged 13 and older who want to incorporate evidence-informed prehabilitation exercises into their training routines.
2. STRICT AGE RESTRICTION
You must be at least thirteen (13) years of age to use Preventify. This restriction is absolute and without exception. Users under the age of 13 are strictly prohibited from using the App, regardless of parental or guardian consent. No parental consent, guardian supervision, or coach oversight permits use by individuals under 13.
By using the App, you represent and warrant that you are at least 13 years of age. If you are between 13 and 17 years of age, you represent that a parent or legal guardian is aware of and consents to your use of the App.
If we have reason to believe a user is under 13, we will delete the account and all data associated with it.
3. NOT MEDICAL CARE
Preventify provides general fitness and injury-risk reduction exercises for informational purposes only. The content in this App is NOT medical advice, diagnosis, treatment, physical therapy, or rehabilitation. Preventify does not replace the guidance of a licensed physician, physical therapist, athletic trainer, or any other qualified healthcare professional.
If you have an existing injury, chronic pain, or a medical condition, you must consult a healthcare provider before using this App. You should stop using the App immediately if you experience pain, dizziness, or discomfort beyond normal exertion.
4. ASSUMPTION OF RISK
Physical activity carries inherent risks, including but not limited to muscle strains, joint injuries, falls, ligament tears, bone fractures, and cardiovascular events. By using Preventify, you acknowledge and voluntarily assume all risks associated with performing the exercises and programs provided.
You are solely responsible for:
- Exercising within your own physical limits
- Using proper form and technique
- Making appropriate modifications as needed
- Stopping immediately if you experience pain or discomfort
- Consulting medical professionals when appropriate
5. NO GUARANTEES
Preventify does not guarantee that using the App will prevent injuries. Injury prevention depends on many factors including genetics, training load, recovery, nutrition, coaching, biomechanics, and individual physiology. The exercises and programs are designed to support injury risk reduction but cannot eliminate risk entirely. No warranty of results is made or implied.
6. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PREVENTIFY LLC, ITS OWNERS, OFFICERS, MEMBERS, EMPLOYEES, DEVELOPERS, CONTRIBUTORS, AND AFFILIATES SHALL NOT BE HELD LIABLE FOR ANY INJURIES, DAMAGES, LOSSES, OR CLAIMS ARISING FROM THE USE OF THIS APP, INCLUDING BUT NOT LIMITED TO:
- Physical injuries sustained during exercises
- Aggravation of pre-existing conditions
- Data loss due to device failure, App deletion, or software updates
- App malfunctions, bugs, or errors
- Reliance on any content provided within the App
USE OF PREVENTIFY IS ENTIRELY AT YOUR OWN RISK. IN NO EVENT SHALL PREVENTIFY LLC'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO PREVENTIFY IN THE TWELVE MONTHS BEFORE THE CLAIM (WHICH, DURING THE BETA, IS ZERO DOLLARS).
7. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Preventify LLC, its owners, officers, members, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any rights of any third party.
8. DATA STORAGE
Preventify stores your account profile (name, email address, age, gender, primary sport, position, years playing, weekly goal, and how you heard about Preventify), your daily check-in inputs, the workouts generated for you, at most one workout-completion record per calendar day, any feedback you send from the App, and when you last used the App, in our cloud database, hosted by Supabase. This data is used to operate your account, generate your workouts, and restore your progress on a new device. It is not sold or used for advertising, and your location is not collected. See the Privacy Policy for full details.
A working copy of your progress (check-ins, workouts, points, streaks, and achievements) and your settings are also kept on your device so the App works offline.
You acknowledge and agree that:
- You can delete your account and all associated server data at any time from Profile → Delete Account
- Uninstalling the App removes the copy on your device but does not delete your account
- Progress completed while offline is uploaded the next time the App connects; if the device is lost before then, that progress cannot be recovered
- Your account data is hosted by Supabase as described in the Privacy Policy
9. ACCOUNTS AND AUTHENTICATION
Preventify requires an account, created with your email address and a password. Authentication is provided by Supabase Auth; your password is stored only as a salted hash, and Preventify staff never see it. You are responsible for keeping your password confidential and for all activity under your account. 10. ACCEPTABLE USE
You agree to use Preventify only for its intended purpose of personal fitness and injury prevention. You shall not:
- Reverse engineer, decompile, or disassemble the App
- Modify, adapt, or create derivative works based on the App
- Redistribute, sublicense, or commercially exploit any part of the App
- Use the App for any unlawful purpose
- Remove or alter any proprietary notices or labels
11. INTELLECTUAL PROPERTY
All content within Preventify, including but not limited to exercise descriptions, workout programs, branding, logos, design, user interface, and underlying code, is the intellectual property of Preventify LLC. All rights are reserved. Unauthorized reproduction, distribution, or commercial use is strictly prohibited and may result in legal action.
12. DISCLAIMER OF WARRANTIES
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. PREVENTIFY LLC DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
13. BETA ACCESS, PRICING AND SUBSCRIPTIONS
During the beta, Preventify is free. No payment is collected inside the App and no subscription is created. If paid plans are introduced later, they will be sold only through the Apple App Store or Google Play, under their billing terms, with the price, billing period and cancellation steps shown before you are charged. Beta testers will be told before anything changes.
If you are using Preventify as part of a beta test, TestFlight, or early access program, you acknowledge that the App may contain bugs, incomplete features, or errors. You agree that:
- Beta versions are not final products
- Features may change or be removed without notice
- Feedback provided during testing may be used to improve the App without compensation
- Beta versions may be less stable than production releases
14. MODIFICATIONS TO TERMS
Preventify LLC reserves the right to update or modify these Terms of Service at any time without prior notice. Updated Terms will be made available within the App. Continued use of the App after any modification constitutes acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
15. PRIVACY
Your use of Preventify is also governed by our Privacy Policy, which describes what information is stored on your device and in your account, how it is used, and how to delete it.
16. TERMINATION
You may terminate your use of the App at any time by deleting it from your device. Preventify LLC reserves the right to modify, suspend, or discontinue the App at any time without notice or liability.
17. SEVERABILITY
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
18. ENTIRE AGREEMENT
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Preventify LLC regarding the use of the App, superseding any prior agreements or understandings.
19. GOVERNING LAW AND JURISDICTION
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law principles. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Kendall County, Texas, and you consent to the personal jurisdiction of such courts.
